Introduction

This Privacy Notice is designed to inform you about the personal data relating to you which the European Free Alliance/Alliance Libre Européenne (EFA/ALE), with registered office at 1 Rue de la Pépinière/Boomkwekerijstraat, 1000 Brussels, Belgium and registered as European political party under number EUPP 6 BE 0866.016.691 (acting as data controller and hereinafter referred as “We”,“Our”and“Us”) collects, inter alia, via the website “https://e-f-a.org/” (referred to hereinafter as the “Website”), why We collect and process such personal data, on which legal basis, and how We will handle personal data you provide Us with and personal data We learn about you from your visit to the Website. Your use of the Website implies your acknowledgment of this Privacy Notice.

The European Free Alliance, the Coppieters Foundation and the European Free Alliance Youth, jointly collect personal information in the framework of the registration of participants to their General Assembly through online forms. The special provisions applicable are contained in the paragraph “Joint controllers”. The other provisions of this policy are applicable as compatible.

Legal basis

We process your personal data on the basis of your specific consent.

Since the processing of your personal data is based on your consent, you have the right to withdraw such consent at any time, without affecting the lawfulness of such processing before the withdrawal of your consent.

Personal data collected

We collect personal data relating to you (referred to hereinafter as “Personal Data”) through:

  • the filling of forms collecting information that you choose to enter on certain pages of the Website. The information marked with the “*” symbol must be provided, in order to enable Us to fulfill the processing purposes, as mentioned below. Such Personal Data directly collected from you include your first and last name, nationality, personal or professional address, personal or professional email address, personal or professional mobile or other phone number, payment and bank details, other personal information or contact information you provide Us with. We may also ask for your comments, suggestions, or other information relating to the Website.

Use of Personal Data

Your Personal Data will exclusively be used to the extent necessary to allow Us:

  • to respond to your request addressed to Us;
  • to manage your use of the Website;
  • to send you newsletters or other communications about Our activities;
  • to report donations in accordance to the applicable laws.

We may combine the Personal Data you submit with other personal data We have obtained about you for the same purposes from other sources, including if you have provided your information to Us in other places or through another medium (such as social media platforms). These sources are: previous activities, including but not limited to statutory meetings, organized by the European Free Alliance or by the European Free Alliance in partnership with third organizations.

We may not use your Personal Data for new purposes which are as yet unforeseen in this Privacy Notice except on the basis of an applicable statutory permission. In any event, prior to using Personal Data for other purposes, We will inform you about such change to this Privacy Notice. In case of consent-based activities, We will not process your Personal Data for such new purposes without first obtaining your consent.

Use of Personal Data of Donors

We collect the name, surname, address of residence, including the country and email address of all the donors. The data is collected in compliance with the Regulation (EU, Euratom) no 1141/2014 of the European Parliament and of the Council of 22 October 2014 on the statute and funding of European political parties and European political foundations (Regulation (EU, Euratom) no 1141/2014).

We are committed to ensure the highest degree of transparency and compliance with Belgian and European legislation on the funding of European political parties. For this reason and in accordance with the provisions of Article 20 of the Regulation (EU, Euratom) no 1141/2014, We can only accept donations up to a value of EUR 18 000 per year and per donor (natural or legal persons indistinctly).

The names of donors and their corresponding donations are reported to the European Parliament in accordance with Article 20(2), (3) and (4) of the Regulation (EU, Euratom) no 1141/2014.

Donations to European political parties are published in the website of the European Parliament in accordance to Article 32(1) of the Regulation (EU, Euratom) no 1141/2014.

Donations from natural persons the value of which does not exceed EUR 1 500 per year and per donor will be published under the aggregate category of “minor donations” without the specification of the amounts and the corresponding donors.

Donations from natural persons the annual value of which exceeds EUR 1 500 and is below or equal to EUR 3 000 will be published only after the corresponding donors have provided their prior written consent to their publication. If no such prior consent has been given, such donations shall be reported together with “minor donations”.

Every donation from a natural person exceeding the value of EUR 3 000 will be published indicating the amount and the details of the corresponding donors.

According to Article 20(5) of the Regulation (EU, Euratom) no 1141/2014, We cannot accept:

  • Anonymous donations or contributions
  • donations from any public authority from a Member State or a third country, or from any undertaking over which such a public authority may exercise, directly or indirectly, a dominant influence by virtue of its ownership of it, its financial participation therein, or the rules which govern it; or
  • donations from any private entities based in a third country or from individuals from a third country who are not entitled to vote in elections to the European Parliament.

Joint controllers

The European Free Alliance, jointly with the Coppieters Foundation a European political foundation registered under the number EUPF 6 BE 0892.342.491 and the European Free Alliance Youth, a Belgian association without lucrative purpose registered in Brussels under the number 0870.658.439, all three having their legal seat at 1 Rue de la Pépinière, 1000 Brussels, Belgium, conduct activities related to the organisation and performance of their General Assembly registration. To this end, they collect and process personal information through an online form.

For this Data Processing the three organisations shall be considered joint controllers under the Regulation (EU) 2016/679 of the European parliament and of the council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”)

In compliance with art. 26 GDPR, they have entered into a joint controllers arrangement pursuant to which EFA shall be considered the contact point for the authority, the data subjects and the data processors and may be reached via the following email address: “info@e-f-a.org”.

No processing of special category of personal data

We will not collect or process any special category of personal data relating to you, unless you have given us your explicit consent. The special categories of Personal Data include data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or other beliefs of a similar nature, trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, health, sex life or sexual orientation.

No processing of personal data relating to criminal convictions and offences

We will not collect or process Personal Data relating to criminal convictions and offences unless such processing is authorized or compulsory under EU legislation or applicable Member State law.

Direct marketing

We will not use your Personal Data for direct marketing purposes without your explicit prior consent, except where authorised under applicable law.

If at any time you decide not to receive any commercial or promotional information from Us, You may, free of charge and without having to provide any justification, opt-out of any direct marketing campaigns and oppose to the future processing of your Personal Data for such purposes by sending Us an email at info@e-f-a.org and mention “opt-out” in the subject of your email. Alternatively, you may use the opt-out procedure provided in any promotional message you receive from Us.

Please note that opting out from receiving promotional messages from Us will not prevent you from receiving information that relates to any contract you may have entered into with Us.

No automated decision-making

We will not make use of automated decision-making processes, including profiling, unless such decision is either necessary for entering into or performance of a contract between you and Us, or authorised by EU legislation or applicable Member State law, or based on your explicit consent. In such case we would inform you about the logic involved in the decision, as well as the significance and the envisaged consequences of such processing for you.

Sharing Personal Data and transferring Personal Data to third countries

We will not make your Personal Data available to any third party and shall not publicly disclose the Personal Data unless such transfers are based on your specific consent, necessary for the performance of a contract entered into between you and Us, or when such transfer of Personal Data is otherwise authorised or compulsory by law or by order of an administration or judicial authority.

We may transfer your Personal Data to the following recipients:
